Spain still treats oral CBD oils harder than cosmetics

What changed for buyers in July 2026

Spain remains one of the stricter EU CBD markets. CBD itself is not treated as a narcotic, but AESAN food law and AEMPS product classification still split the shelf: cosmetics for external use can be workable under Regulation (EC) 1223/2009, while CBD added to foods or sold as oral oils and supplements stays blocked as an unauthorised novel food under Regulation (EU) 2015/2283.

EFSA’s February 2026 provisional safe intake for high-purity CBD (about 2 mg/day for a 70 kg adult) is a risk-assessment reference only. It is not a Commission Novel Food authorisation and does not green-light Spanish ingestible CBD.

What it means if you shop in Spain

• Cosmetics and topicals: Cleanest retail lane when sold for external use only, properly notified, without therapeutic claims, and with a COA showing no prohibited THC contamination.
• Oral oils, gummies, capsules: Highest compliance friction. Availability online does not equal authorisation. AESAN’s line is that cannabinoids in food remain unauthorised novel foods.
• THC headlines: Many shops still quote 0.2% as the safer Spain-facing assumption. Broader EU hemp talk at 0.3% does not erase the Novel Food problem for ingestibles.
• Flowers: Highest real-world risk. They look like cannabis and create more seizure and classification friction than a compliant cream.

How this compares across Europe

France is currently hitting edibles hardest with DGAL Novel Food controls. Germany still sells OTC oils under a 0.3% total THC BtMG frame but keeps Novel Food grey for ingestibles. The Netherlands enforces domestic oils near ~0.05% THC. Spain’s distinctive buyer message is category-first: cosmetics before swallowable oils.
