CBD oil Europe: legality, travel, and how to compare
Direct answer: There is no single Europe-wide rule that makes every CBD oil legal. A food or supplement sold in the EU must fit novel-food rules, stay inside the destination country’s THC limit, and match that country’s product category. The UK runs a separate system. Delivery across a border does not make the bottle lawful where it arrives.
This page is general information, not legal or medical advice. Recheck official sources before you buy or travel.
Is CBD oil legal in Europe?
Legality is four checks at once:
- Country. Member states enforce their own rules on top of shared EU law.
- Product category. Food supplement, cosmetic, vape, and medicine are different regimes.
- THC content. Limits differ by country and category. Do not reuse one country’s number in another.
- Route. Buying locally, importing, and carrying oil through an airport are not the same event.
If a CBD oil is marketed as a food, Regulation (EU) 2015/2283 on novel foods applies and authorisation is required before sale. National enforcement still sits on top of that.
Travelling with CBD oil in Europe
An oil that was fine at home can be a problem at the destination or in transit. Before you fly:
- Confirm the destination country’s current THC limit and category rules.
- Check the airline. Some ban all cannabinoid products regardless of local shops.
- Carry the batch laboratory report that lists CBD and THC.
- Do not assume intra-EU movement covers CBD. Checks happen nationally.
- For the UK, use the UK section below. It is not an EU novel-food file.
If you cannot finish those checks, leave the bottle at home.
Full-spectrum CBD oil in Europe
Full-spectrum oils include other hemp compounds and may contain trace THC, which must sit inside the destination limit. Broad-spectrum and isolate oils are built to remove THC, which lowers threshold risk when you cross borders. Category and novel-food rules still apply. The document that matters is a current batch report, not a homepage badge that says “EU legal.”
Country questions
Is CBD oil legal to buy and use in Germany?
Key parts of the Cannabis Act took effect on 1 April 2024 and treat consumer and medical cannabis separately. CBD itself is not a narcotic, and CBD products are widely sold, but the lawful path depends on whether the SKU is a food, a cosmetic, or something else. Confirm the category with a current official German source. This page does not declare any retail SKU lawful.
Can you legally buy CBD oil in the UK?
Three checks:
- Novel food. Edible CBD sits under Food Standards Agency rules. The FSA publishes a public CBD product list tied to applications (England and Wales). Products missing from the list, or marked Removed, are advised for withdrawal. Scotland and Northern Ireland have separate guidance.
- THC. THC remains controlled. A CBD product avoids drugs-law prohibition only if it meets the “exempt product” definition, including the one-milligram-per-component limb described in the Home Office cannabinoid licensing factsheet.
- Seller. Identity plus a batch report that matches the bottle.

Is CBD oil legal in France?
France removed CBD from its narcotics list from 1 January 2021 under defined conditions. ANSES has also proposed classifying CBD as a presumed reproductive toxicant; that is a classification proposal, not a final consumer ban. Confirm the current framework for the exact product.
Can I buy CBD oil in Italy?
Law 242/2016 covers industrial hemp cultivation and processing. Retail CBD oil has moved through court rulings, so a blanket yes is unsafe. Check category, THC, and current enforcement, especially on full-spectrum oils.
How to compare oils (after the legal check)
- Filter sellers that will not deliver to your country.
- Open the current lab report and match the batch number.
- Compare EUR price per milligram of stated CBD, not bottle size.
- Treat “organic” and “CO2” as claims to verify.
- Read returns and what happens if customs blocks the parcel.
Reject listings that hide batch details, promise to treat a disease, or will not name the seller.
FAQ
Which CBD oil is best for pain relief?
No retail CBD oil in Europe is authorised to treat pain. Marketing that says otherwise is a claim problem, not a shopping tip. If you have pain, talk to a clinician. If you still compare wellness oils, compare batch reports and destination-country rules, not pain promises.
Which CBD oil is best for joint pain relief?
Same answer. Joint pain is a medical issue. This site will not rank oils for it.
Can I order CBD oil online to my country?
Many shops ship cross-border. The receiving country’s rules decide whether that is lawful. Do the destination check first.
What THC limit applies in Europe?
There is no single figure. Verify the limit for your country and category.
